2012 - Accommodation Promotional Partners Advertising Package

The ERTC operate a Quality Policy that aligns to the objectives of the locally adopted tourism strategy: ‘Turning the Tide for Tourism in Torbay’ 2010 – 2015

Our overall objective is to raise quality across the resort, meet modern customer expectation and align to national policy and minimum standards.

Below our terms and conditions are specified for 2012 and relate specifically to the accommodation providers who would like to work with us as English Riviera Promotional Partners.

You will need to confirm that you have read and accept the terms before proceeding with completing your advertising application. 

  1. Applications for advertising space from accommodation advertisers (“the Advertiser”) will only be accepted by Advertisers situated within or operating close to Torbay boundaries and who:
    (1.1) comply with the voluntary code of booking practice 
    (1.2) possess all necessary planning and other statutory operating approvals
    (1.3) have a full fire certificate
    (1.4) are exempt from uniform Business Rates (6 bed spaces or less).
  2. Accommodation Inspection. All Advertisers must have been officially inspected to be marketed by the ERTC prior to the brochure being published via
    (2.1) The English Riviera Approved basic inspection scheme, accredited by Visit England
    (2.2) The National Quality Assessment star grading scheme operated by Quality in Tourism or the AA
    (2.3) A nationally recognised body such as Alistair Sawday or any other body approved by the ERTC
    (2.4) Proof of inspections, gradings and awards will be checked by the ERTC with the official authorities and any business not graded as advised to the ERTC will be removed from the Promotional Partner campaigns.
    (2.5) It is the responsibility of the advertiser to ensure gradings are correct at the time of going to press and any changes to gradings must be notified to the ERTC by 30th September 2011.
  3. No advertisement position can be guaranteed to Advertisers by the ERTC. The ERTC reserve the right to decide the position of all advertisements according to the pagination structure determined by the ERTC and the design company.
  4. Display Adverts Cost of advertising space does not include the cost of design and artwork etc, which must be provided by the Advertiser at his/her own cost if booking a display style advert. Proofs of adverts will be sent direct from the design company for your approval.
  5. Standard style adverts will receive one proof on which to make any amends. Any further proofs will be subject to an administration fee of £15 per amend. The only exception to this will be amends to accommodation grading. Proofs of adverts will be sent direct from the design company for your approval.
  6. Extra Charges. Any extra charge by the designers for a setting considered by them to be special, or for alteration to proofs which in their opinion warrant a charge, must be paid for by the Advertiser direct to the design company.
  7. Photography.  The ERTC requests that quality photographs should be used where illustrations are included in advertisements. If line drawings are to be used they must be submitted for approval in the first instance. Photographs and designs considered by the ERTC or the printers to be unsuitable for satisfactory reproduction or in any other respect will not be accepted as poor photography can damage the overall quality of the brochure. In such cases the Advertiser must provide new photographs and designs.
  8. Proofs. of all work will be submitted to Advertisers for their approval and the ERTC shall incur no liability for any errors not corrected by the advertiser in proofs submitted. Proofs of adverts will be sent direct from the design company for your approval.
  9. Cancellation of advertisements.  If an advertisement has not been design set by RH, all monies, minus a £25.00 +VAT administration cost, will be refunded. If an advertisement has been set by the designers but is not yet at proof stage, 50% of all monies will be refunded. If an advertisement has been set by the printer, no monies will be refunded. All refunds are made at the discretion of the ERTC and their say is final.
  10. Liability. If any liability on the part of the ERTC shall arise to the Advertiser (whether under the express or implied terms of this agreement or at common law or in any other way) for any loss or damage of whatever nature arising out of, or purported provision of, the advertisement the subject the agreement, such liability shall be limited to the payment by the ERTC to the Advertiser by way of damages of a sum equivalent to the total cost of the advertisement.
  11. Technical Failures. The ERTC cannot be held responsible for technical failures within the Destination Management System (DMS) including the online booking service and/or the content and availability of the website. Any apparent faults will be reported by the ERTC to the relevant supplier. If any liability on the part of the ERTC shall arise to the Advertiser (whether under the express or implied terms of this agreement or at common law or in any other way) for any loss or damage of whatever nature arising out of, or purported provision of the online or sales centre element of this agreement, such liability shall be limited to the payment by the ERTC to the Advertiser by way of damages of a sum not exceeding 25% of the total cost of the advertisement package.
  12. Copy. Responsibility for editorial copy offline and online lies entirely with the Advertiser, not the ERTC. The Advertiser will be responsible for updating the copy content of the DMS and all extranet availability. The ERTC retain the right to amend or remove any copy that they consider unsuitable and to apply word restrictions on copy length to ensure a consistent quality look particularly to the web site.
  13. Content Suitability. If the ERTC in their sole discretion consider that any statement or illustration contains unsuitable content they may delete and in the case of a printed or published advertisement, remove or obliterate any such statement or illustration, or the advertisement in whole or part in such a manner that they consider necessary.
  14. The ERTC reserve the right to refuse to accept or to cancel any advertisement.
  15. ERTC Inspection. The ERTC reserve the right to inspect the premises of any Advertiser should they so wish.
  16. Trade Descriptions Act. All Advertisers are reminded of their responsibilities under the Trade Descriptions Act, 1968 together with the Tourism (Sleeping Accommodation Price Display) Order, 1977. Any descriptions of accommodation, services, distances, facilities or special category listings must be accurate and true. This includes any indication of the approval or evaluation of the standard of accommodation etc, such as is given by Quality in Tourism, AA or any other independent organisation approved by the ERTC. Advertisements and copy are only accepted on the condition that the descriptions given are correct in every respect.
  17. Publication Dates. All publication dates for ERTC publications are approximate and no undertaking is given that publications will appear on that date.
  18. Payment. Payment details must be supplied at time of completing the booking form. All monies owed with regard to instalment plans will need to have been paid by 31st December 2011. Any late payments will be referred to the council debt department for collection.
  19. Publication Integrity.  All advertisements must be in keeping with the integrity of ERTC publications and conform to advertisement specifications. Proposed joint advertisements from two or more separately owned establishments must be approved by the ERTC before they can be accepted.
  20. Resale of advertising space is not permitted without prior permission of the ERTC.
  21. Pricing Presentation. All prices for serviced accommodation will be appear as a per room, per night price, based on 2 people sharing. It is the responsibility of the advertiser to ensure that pricing information is specified correctly on their booking form.
  22. ERTC Commission for Accommodation Bookings. All accommodation bookings made by the ERTC are subject to a commission 10% of the total stay, which will be advised at the time of the booking.
  23. Complaints.   If the ERTC receives a complaint against your establishment, this will be forwarded to Quality in Tourism for their information and/or action. If Quality in Tourism deems the complaint to be serious, they will arrange a visit from their inspectors.  If the complaint is upheld there will be a charge of £76.50 plus VAT to the accommodation provider, payable to the ERTC.
